Your continued use of this site after changes are posted means you agree and/or otherwise shall be deemed to agree to be legally bound by the updated and/or amended terms and conditions. 

1) Accessing and Using This Site

- you shall be solely responsible for your access to and/or use of this site and its materials herein.

Where you create a user account and password, you must treat such information as confidential, and you must not disclose it to any third party. We reserve the right to disable any user account at any time, if we think you have failed to comply with any of the provisions of these T&Cs.

You agree to use this site only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use of the site. Prohibited behaviour includes harassing or causing distress or inconvenience to any person or transmitting obscence or offensive content.

Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any license or right to use any trademark, patent, design right or copyright of the Company.

You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise without the prior written permission of the Company. This includes adapted, altered or derivative work.

3) Disclaimers and Limitation of Liability

The content provided on this site including the information, names, images, pictures, logos and icons regarding or relating to the Company, its products and services, is provided “AS IS” and on an “IS AVAILABLE” basis without any representation or any kind of warranty made to the extend permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. The Company does not warrant that service of our content will be uninterrupted or error free or that any content is free of viruses or bugs.

Under no circumstances whatever will the Company be liable for any loss of data, loss of revenue or anticipated profits, loss of business, loss of opportunity, loss of goodwill or injury to reputation, loss suffered by third parties or any indirect, consequential or examplary damages arising from the use of this site regardless of the form of action.

Without prejudice to the generality of the foregoing, we expressly disclaim any and all liability arising from:

- life or wear of any Product or that it will be suitable for any particular purpose or use under any specific conditions, not with standing that such purpose or conditions may be known or made known to Company, to the extent permissible under applicable law;

- improper remedy of defective products, alteration of the products, unsuitable or improper use, wilful damage, negligence, or other misuse of the products, as well as fair wear and tear, by you or any third party;

- third party claims, whether directly or indirectly caused by, or relating to, the content of our Site and the products purchased on or through our Site; and

- any warranties provided under these T&Cs if the total price for the Product has not been paid in cleared funds by the due date for payment.

Your further acknowledge and agree that your access and use of the Site is dependent on third party service providers such as internet, network, connectivity or other link providers. Your payment for any Product purchased from the Site is processed by third party payment system providers and Enzo Marketing Sdn. Bhd.  does not  retain or process any such payment information. Enzo Marketing Sdn. Bhd. cannot guarantee the security of such third party payment system(s) or any payment data on the Site, Enzo Marketing is not responsible for any acts or omissions of any third parties and disclaims any and all liability in connection with the acts, omissions or defaults of such third parties. 

4) Products Description and Deffects

We try to be accurate as reasonably possible in our descriptions of products available for purchase through the Site. However, our products may vary slightly from the pictures. The images of the products on Site are for illustrative purpose only. Colors may appear slightly different in reality due to studio lighting conditions, or variances in computer screen calibration. Colors may vary slightly between dye lots as well which mean the same product purchased in different order might appear slightly different in color tone. We do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current or error-free. Minor variations in measurement (within 0.5 inches) are not considered a defect.  Buyer are responsible for ensuring that your sizing measurements are accurate.

5) Indemnities

You agree to indemnify, depend, hold harmless Enzo, its directors, officers, employees, subsidiaries, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including but not limited to, legal fees) arising from your use of this Site or your breach of the Terms and Conditions. 

 

6) Termination

Enzo have the right to determine in our sole discretion whether there has been a breach of these Terms and Conditions through your use and/or access of the Site. When a breach of the Terms and Conditions has occurred, Enzo will terminate or suspend your account, delete your profile or any of your user content, and restrict your use of all or any part of the Site at any time and for any reason, without any liability to Enzo, subject to applicable law.
